” 25 In paragraph 41 of the contested decision, the Board of Appeal took the view that the earlier mark consisted of two co-dominant elements and that both the figurative element and the word ‘compal’ were distinctive and would attract the attention of the relevant public. It stated that the figurative element, because of its size and eye-catching graphic design, did not play a secondary or merely descriptive role within the mark. Nonetheless, in the Board of Appeal’s view, the word element of the earlier mark plays a ‘somewhat more important’ role within that mark, given that it is the only element of that mark that can be pronounced. As regards the mark applied for, the Board of Appeal took the view that it was also composed of two co-dominant elements, namely the words ‘copal’ and ‘tree’, but that it was to the first word, namely ‘copal’, that the relevant public would pay more attention.

26      In addition, the Board of Appeal was of the opinion, in paragraph 42 of the contested decision, that the signs at issue were both fully distinctive and that neither the figurative element of the earlier mark nor the word ‘tree’ of the mark applied for could be regarded as weakly distinctive elements merely referring to the possible ecological characteristics of the food products at issue”.

Molto simile invece è l’aspetto fonetico, § 56.

Stanti questi presupposti, difficile evitare il giuidizio di confondibilità, che infatti arriva:

<< 61    In that regard, first, as regards the similarity of the signs at issue, it should be noted that, as stated in paragraphs 41, 47 and 56 above, the Board of Appeal did not make an error of assessment in finding that those signs were visually and phonetically similar to an average degree and conceptually similar to a high degree. Accordingly, contrary to what the applicant claims, those similarities are not too weak.

62      Secondly, as regards the distinctive character of the earlier mark, the parties do not dispute that it must be regarded as normal, as the Board of Appeal found.

63      Thirdly, as noted in paragraphs 20 to 22 above, the goods and services at issue are in part identical and in part similar and the relevant public will have an average level of attention.

64      In the light of all those factors, the Board of Appeal did not make an error of assessment in concluding that there was a likelihood of confusion.

65      In the light of the foregoing, the single plea in law alleging infringement of Article 8(1)(b) of Regulation 2017/1001 must be rejected and, consequently, the action must be dismissed in its entirety, without there being any need to rule on the admissibility of the head of claim seeking annulment of the Opposition Division’s decision of 2 June 2020.>>

Gli va male anche davanti al Trib. UE, sent. 28.09.2022, T-454/21, G-Core Innovations Sàrl c. EUIPO+1.

Elemento dominante è la lettera G << 40   It follows that the Board of Appeal did not err in finding, in paragraphs 35, 36 and 41 of the contested decision, that the dominant element of the mark applied for was the figurative element representing a letter ‘G’, that the word element ‘core’ had an average degree of distinctiveness for the non-English-speaking part of the relevant public and, lastly, that the element ‘labs’ was weakly distinctive both for the English-speaking and non-English-speaking parts of the relevant public.>>

Profilo fonetico: << 54 Therefore, in the light of the presence of the word element ‘core’ in both the signs at issue, its position in the pronunciation of the mark applied for and all the other phonetic elements of which it consists, which are liable to create impressions of phonetic differences between the marks at issue, the Board of Appeal was correct in finding that the signs at issue were similar to at least a lower than average degree.>>

Vicinanza concettuale (interessnte la distinzione a seconda della lingua): << 59  Therefore, having regard, first of all, to the lack of conceptual meaning produced by the figurative element and the element ‘G’ of the mark applied for, next, to the meaning conveyed by the element ‘core’ for the English-speaking public and its lack of meaning for the non-English-speaking public and, lastly, to the meaning, for the relevant English-speaking and non-English-speaking public, of the element ‘labs’ in the mark applied for, the Board of Appeal was correct in finding that the marks at issue were conceptually, first, dissimilar for the non-English-speaking part of the relevant public and, secondly, similar to an average degree for the English-speaking part of the relevant public.>>

Giudizio complessivo (non facilissimo, stanti i presupposti di ridotta vicinanza e elevata attenzione del consumatore, ma con soprapponilità merceologica). << 73   Therefore, having regard, in particular, to the identity and similarity of the goods and services at issue, the low degree of visual similarity, the lower than average degree of phonetic similarity, the average conceptual similarity for the English-speaking part of the relevant public and, lastly, the lack of conceptual similarity between the marks at issue for the non-English-speaking part of the relevant public, offset, inter alia, by the existence of an average degree of distinctiveness of the earlier mark in respect of that public, the Board of Appeal was right to find that there was a likelihood of confusion both for the English-speaking and non-English-speaking parts of the relevant public and that notwithstanding the degree of attention, varying from average to high, which that public may display in the choice of goods and services at issue.

74      In the light of all of the foregoing, the single plea in law of the action, alleging infringement of Article 8(1)(b) of Regulation No 207/2009, must be rejected.>>

Marchio denominativo/figurtivo descrittivo e qundi nullo per prodotti alimentari

Questo il marchio in esame per prodotti alimentari, respinto dall’ufficio perchè privo di distintiva (art. 7.1.b-c reg. UE 2017/1001).

Il Tribunale UE con sentenza 28.09.2022, T-58/22, Miroslav Labaš c. EUIPO, conferma :

<< 34   in the light of the foregoing, the Court finds that the word element ‘fresh’ of the mark applied for will naturally be perceived by the English-speaking public of the European Union, immediately and without further thought, as a descriptive indication of a characteristic or the intended purpose of all the goods and services covered by the application for registration, and not as an indication of their commercial origin. In order for the registration of a mark to be refused, it is sufficient that there are grounds for refusal in part of the European Union (see, to that effect, judgments of 8 July 2004, MLP Finanzdienstleistungen v OHIM (bestpartner), T‑270/02, EU:T:2004:226, paragraph 21, and of 27 September 2005, Cargo Partner v OHIM (CARGO PARTNER), T‑123/04, EU:T:2005:340, paragraph 57).

35      Thus, the Court considers that there is a sufficiently direct and specific relationship between the word element ‘fresh’ of the mark applied for and all the services at issue, with the result that the relevant English-speaking public will immediately perceive, without further thought, a description of those services or of one of their characteristics.

36      As regards the figurative elements of the mark applied for, the Court finds that they have, as such, no element that is visually eye-catching or likely to be remembered by the relevant public. As is rightly noted by the Board of Appeal, those figurative elements do not divert the attention of that public away from the descriptive word element of that mark, but, on the contrary, reinforce that descriptive character by the representation of two green leaves, which recall the concept of fresh and natural.

37      Nor are the stylisation of the letters of the word element ‘fresh’ of the mark applied for or their red colour likely to hold the attention of the relevant public.

38      Accordingly, the figurative elements of the mark applied for are not, because of the representation of two stylised green leaves, or the stylisation or the colour of the letters, particularly complex; nor are they capable of offsetting or altering the descriptive character of the word element of that mark in relation to the goods and services at issue.>>

Decisione non difficile: l’assenza di distintività è palese.

Il Trib. conferma anche per servizi (classe 39), in quanto correlati ai prodotti alimentari . E’ il punto meno scontato della decisione :

<<30   As regards the services in Classes 35 and 39 covered by the mark applied for, it should be noted that the relevant English-speaking public will directly perceive the word element ‘fresh’ as providing information concerning the kind, quality and intended purpose of those services, since that element may be associated with the object, aim or field of specialisation of the services in respect of which registration of the mark is sought.

31      In particular, a direct descriptive link will always be established in the mind of the relevant public between the word element of the mark applied for and the services at issue, which consist of: (i) the retail sale of foodstuffs and beverages, which the relevant public will identify as fresh goods which are not cooked, have been recently obtained, or have been prepared with fresh goods that have been recently cooked, frozen, canned or preserved by other methods; (ii) the retail sale of toiletries, cleaning preparations and beauty and hygiene products which provide a degree of freshness or contain ingredients that the relevant public will identify as being fresh or as conveying a feeling of freshness and cleanliness; (iii) the retail sale of freezing equipment, the ultimate aim of which is preserving the freshness of retailed products; (iv) the retail sale of tobacco, a product which the relevant public will perceive as being fresh (for example, fresh tobacco leaves), or associated with air fresheners used to counteract the smell of tobacco; and (v) business, administrative, advertising and marketing services which could be specifically aimed at undertakings operating on the market of fresh goods and at companies marketing fresh foodstuffs and beverages.

32      Although the last set of services covered by the mark applied for – business, administrative, advertising and marketing services – are not expressly aimed at undertakings which operate on the market of fresh goods and at companies which market fresh foodstuffs and beverages, they also include specific services which could be used by such undertakings and companies. Therefore, as regards those generic services, the relevant public will naturally associate the word element ‘fresh’ with a characteristic of those services and will easily assume that the services in Class 35, which are normally for the purpose of running a business and facilitating the sale of goods or services, are specialised in the field of fresh goods.

33      As regards the services relating to the packaging and storage of goods in Class 39, it is sufficient to note that the main aim of those services is to keep goods fresh and to avoid any deterioration. Consequently, the word ‘fresh’ may be perceived by the relevant public as a direct indication that the goods which are packaged and stored by using the applicant’s services will be kept fresh in the sense that they will maintain their characteristics and properties.>>

“Trump too small”: incostituzionale il rifiuto di registrazione di marchio denominativo evocante l’ex presidente Trump

La domanda di registrazione del marchio denominativo <TRUMP TOO SMALL> per magliette era stata respinta dall’USPTO, perchè non c’era il consenso del titolare del nome e perchè indicava falsamente un’associazione con lui.

La frase si riferisce al noto scambio di battute “fisico-dimensionali” tra Trump e Marc Rubio, di qualche anno fa.

L’impugnazione fondata sulla violazione del diritto di parola venne respinta dal Board amministrativo.

Ma la corte di appello federale 24.02.2022, n° 2020-2205, in re: Steve Elster, rifroma: il rifiuto di registrazione è incostituzionale perchè contrastante appunto col diritto di parola del Primo Emendamento.

Irrilevanti sono sia l’eccezione di privacy (assente per un personagigo pubblico, sub IV, p. 11),  che di right of publicity , non essendoci nè uno sfruttamento della notorietà di Trump (qui è però difficile veder quale legittimazione abbia il Governo) nè un’induzione del pubblico a pensare che egli abbia dato il suo endorsement al prodotto (su cui avrebbe legittimazione il Governo: sub V, p. 12/4).

Del resto la domanda di marchio e il suo uso costituiscono private speech, p. 5, che può invocare il 1° Emend., anche se per uso commerciale, p. 9.

In conclusione il rifuto di registrazione è annullato.

Mi pare in realtà trattarsi di uso parodistico o meglio satirico.

In UE è discusso se possa invocarsi l’uso parodistico di un marchio altrui, magari rinomato.

In prima battuta potrebbe rispondersi positivamente sulla base di un diritto di parola o di critica (da un lato l’art. 21 cpi e .art. 14 dir. UE 2015/2436 sono muti sul punto ; dall’altro il diritto di manifestazione del pensiero,  se ravvisato nel caso specifico, non sarebbe inibito dalla mancanza di espressa sua previsione).

A ben riflettere, però,  la cosa non è semplice, potendo l’operazione nascondere uno sfruttamento abusivo della notorietà altrui.

Appello delll’EUIPO su marchio di forma/di posizione

Il 5 board of appeal del l’EUIPO del 29.08.2022, R 197/2021-5 , Blake Holdings appl./appellant, decide un interessante fattispecie di marchio di posizione e/o di forma, consistente in colore grigio applicato a battistrada e porzione laterale esterna di copertoni da camion (“The trade mark comprises the tread and outer portion of a tyre in colour light grey (“Pantone 7527 C”) depicted in the area outside the outer broken line, as shown in the attached representation.”>>).

Ravvisa che manchi di distintività, perchè non si distanzia a sufficienza dalle caratteristiche dei copertoni normalmente reperlbili sul mercato

Premesse:

<< 48   Therefore, contrary to the applicant’s statements, both the claimed light grey
colour and its particular position on the tread and outer portion of the off road tyre
are far for being ‘distinct’ or unique. Thus, taken as a whole, the trade mark
applied for will be perceived only as one of the variants of similar part of off road
tyres existing on the market.

49    In this regard, the Board further recalls that a mere departure from the norm or
customs of the sector is not sufficient to overcome the ground for refusal set out
in Article 7(1)(b) EUTMR. For the mark to fulfil its essential function, namely, to
indicate commercial origin, the difference between the sign applied for and the
norms or customs of the sector must be significant (12/02/2004, C-218/01,
Perwoll, EU:C:2004:88, § 49). In other words, any divergence from the way in
which the competing goods are presented is not sufficient in itself to guarantee
the existence of distinctive character. This difference must also be ‘significant’
and therefore immediately apparent to consumers.
50    What is more, a feature displayed in a sign which is functional in nature and
purpose will generally not be able to confer distinctiveness on the mark, as it will
be associated by the target consumer merely with that specific function, and not as
an indicator of commercial origin, and this, independently of whether the (much
stricter) conditions of Article 7(1)(e) EUTMR are also fulfilled (12/09/2013, T-
492/11, Tampon, EU:T:2013:421, § 23; 18/01/2013, T-137/12, Vibrator,
EU:T:2013:26, § 27; 14/11/2016, R 1067/2016-4, Schlüsselprofil, § 21). In the
present case, as indicated in the communication of Rapporteur of 5 May 2022, the
position mark at stake, consisting of the tread and outer portion of a tyre in light
grey, could also be seen as having a certain functionality, i.e. leaving no black
marks on floors during operations. Contrary to the applicant’s submissions, the
Board observes that that the use of tyres with non-marking properties is
potentially of interest also in relation to the claimed goods, i.e., ‘Off road tires
used with construction, industrial and agricultural equipment; none of the
aforesaid being off road tires for forklift trucks’, including the specific goods for
which the applicant claims that the position mark in question will be used, namely
tyres for Aerial Work Platforms (AWPs), as the examples provided by the
rapporteur show>>.

Pertanto :

<< 51  Taking into account all the above, the Board considers that the sign applied for
cannot be considered to depart significantly from the appearance of (part of) tyres
already found on the market. The relevant public, who is confronted with
numerous more or less similar tyres, will neither carry out a detailed analysis nor
a side by side comparison between the trade mark applied for and the other tyres
on the market, and will therefore perceive the mark applied for solely as being a
mere variety of the tread and outer portion of such tyres. There is no evidence that
the public at large or even the professionals would perceive the sign at hand as a
badge of origin.
52 Therefore, contrary to the applicant’s arguments, none of the features invoked or
their combination support the conclusion that the sign applied for departs
significantly from the norms and customs of the sector. It will therefore not be
perceived as a trade mark without having acquired distinctive character through
use.

Il marchio TAKE FIVE per bevande analcoliche è nullo per carenza di distintività

Questa è la conclusione del Board di appello dell’EUIPO 01.09.2022, Case R 664/2022-1 , Studio Beverage Groupo c. EUIPO (segnalata da in IPKat), confermante il primo grdo amministrativo.

Le disposizioni  di riferimento sono gli artt. 7.1.b – 7.2 reg. UE 2017/1001.

IL pubblico di riferimento è quello english speaking e cioè <<In addition to Ireland and Malta, it consists of those countries in which, at the very least, English is widely understood, in particular, Denmark, Cyprus, the Netherlands, Finland and Sweden>> , § 15.

Motivo: << 20   The assertion of the applicant that the sign is distinctive as it does not describe the
goods claimed is entirely unfounded. In the context of the goods applied for in
Class 32 (essentially non-alcoholic drinks, mineral waters), the public will understand the imperative form of the expression ‘take five’ as an invitation to potential customers not to pass by the goods advertised in this way carelessly, but to
take/buy them in a quantity of five. The invitation to buy conveyed by the sign
could also refer to a variety of five different types of drinks or flavours sold in one
pack, since it is common that those products are offered also in packs. Such
invitations to take or buy are not unusual, and there might be even a
compensation for buying several products, in the form of a (quantity) discount.

01/09/2022, R 664/2022-1, TAKE FIVE
21 Moreover, in advertising language, the public is accustomed to being confronted
with English terms that are intended to convey factual information in a memorable form, without recognising in them any indication of origin. In particular, the
use of the imperative form is a common stylistic device in advertising language to
address potential customers directly and to convey an advertising message to
them. With regard to the relevant goods (i.e., non-alcoholic drinks, mineral waters), it is common business practice to offer and sell daily consumption goods
which are often similar in appearance by addressing consumers directly in a verbal or visually striking manner. The present sign is a direct, obvious and also
widely used advertising statement with ‘five’ being used in the sense of a quantity
specification. Therefore, the public is familiar with receiving such advertising
messages in this form.
22 In the light of the foregoing, the word combination ‘TAKE FIVE’ cannot be
regarded as capable of serving as an indication of the commercial origin of the
goods claimed in this case. On the contrary, the relevant public, which is made up
of end consumers, will see in the word sequence ‘TAKE FIVE’, in connection
with the goods in Class 32, exclusively a general laudatory advertising statement
and an appeal to potential customers to buy. There is no evidence whatsoever that
the relevant public perceives the sign applied for, beyond its obvious advertising
and laudatory content.
>>

L’interesse, oltre che nel giudizio in sè, sta anche nel fatto che la mancanza di distintività, qui  affermata secondo la regola generale (art. 7.1.b), non avrebbe invece potuto esserlo secondo le regole particolari (artt. 7.1.c-d-e) (v. da noi l’art. 7.1.a  – 13.1 cpi): dando quindi un senso alla distinzione tra la prima e le seconde, da taluni criticata.

Precisazioni sui marchi: convalidazine, distintività e rapporto tra disciplina ad hoc e concorrenza sleale

Uili precisaizoni da Trib. Bologna n. 1782/2021, Rg 12664/2017, Montedil srl c. Mon.Edil srl, rel. Romagnoli, su questioni frequenti in tema di marchi:

1) << L’istituto della convalidazione può valere, però, solo per il marchio successivo registrato (cfr. Cass. civ.
Sez. I, n. 26498 del 2013) o al massimo per la denominazione sociale e il nome a dominio (che sono
comunque segni distintivi in qualche modo “registrati”) quindi non per il marchio di fatto, quale è quello
(o meglio, quelli) della convenuta (MONT.EDIL IMPRESA EDILE, MONTEDIL COSTRUZIONI
EDILI e MONTEDIL SRL con la raffigurazione dell’escavatore, cfr. docc. 2, 2 ter, 2 bis, 3, 4, 5 e 14);
d’altronde, l’eventuale tolleranza dell’uso della ditta o dominazione sociale MONT.EDIL, non significa
tolleranza nell’uso dello stesso segno come marchio (cfr. Cass .civ. Sez. I, 20.4.2017 n. 9966): dunque in
nessun modo potrebbe esservi convalidazione del marchio
>>, p. 5;

Del resto il tenore della disposizione (art. 28 cpi) è inequivoco.

2) << Va altresì disattesa ogni prospettazione di nullità dei marchi attorei per assenza di capacità distintiva ai
sensi dell’art. 13 CPI: il termine “edil” è senz’altro evocativo del servizio edile, ma è un tutt’uno non
distinguibile nel marchio MONTEDIL che con l’anteposizione del termine “mont” conferisce al segno
nella sua unitarietà una capacità distintiva avulsa dalla natura del servizio prestato; per altro verso, la
circostanza che il termine “montedil” sia utilizzato da diverse imprese nella propria denominazione
sociale non fa di esso un segno divenuto di uso comune nel commercio ai sensi della lett. a art. 13 cit.,
che invece fa riferimento alla parola del linguaggio comune che si pretenda di utilizzare come marchio
>> e poi, superrata la questione della validità di quello aizonaot, affronta quella della legittimità di quello conveuto: << Se ciò è vero, appare chiaro che anche a considerare la natura “debole” del marchio “montedil”
l’introduzione di un punto fra “mont” ed “edil” non è variazione sufficiente ad escludere la confondibilità
fra i servizi richiamati dal segno; d’altronde, pur riconoscendosi che il marchio MONT.EDIL è stato
utilizzato assieme ad altri elementi (terminologici o figurativi) reputa il collegio che tali elementi
aggiuntivi non riescano a controbilanciare la somiglianza (quasi identità) fonetica e morofologicolessicale.
Va dunque riconosciuto che l’uso del segno “montedil” comunque scritto (con l’inserimento del punto
fra “mont” ed “edil” ovvero con l’aggiunta di ulteriori termini come “impresa edile” o “costruzioni edili”
o di elementi figurativi come l’escavatore stilizzato) da parte della convenuta è in violazione dei marchi
registrati attorei ex art. 20/1° co. lett. b) CPI, e conseguentemente ne va disposta l’inibitoria da ogni
utilizzo, anche quale denominazione sociale e nome a dominio.
Quanto specificamente al nome a dominio
www.montedilparma.com il collegio apprezza che l’aggiunta
del termine “parma” neppure valga a differenziare adeguatamente il segno rispetto ai marchi dell’attrice,
perché l’indicazione territoriale associata alla denominazione sociale semmai induce il mercato a ritenere
che il segno sia riconducibile ad unità territoriale dell’impresa piuttosto che a diversa impresa avente la
stessa denominazione, sicchè non consiste in idoneo elemento qualificante a designare la convenuta e ad
escludere il rischio associativo fra imprese
>>, p. 6

3) << Va disattesa la domanda concernente la concorrenza sleale confusoria (art. 2598 n. 1 c.c.) sulla quale
domanda il collegio osserva quanto segue.
Sebbene siano astrattamente compatibili e cumulabili la tutela dei segni distintivi prevista dal codice
della proprietà industriale e quella prevista dal codice civile in tema di concorrenza sleale (in tal senso è
chiaramente l’
incipit dell’art. 2598 c.c.), va condiviso il principio per cui la medesima condotta può integrare sia la contraffazione della privativa industriale sia la concorrenza sleale per l’uso confusorio di
segni distintivi solo se la condotta contraffattoria integri anche una delle fattispecie rilevanti ai sensi
dell’art. 2598 c.c., cioè a dire che va esclusa la concorrenza sleale se il titolare della privativa industriale
si sia limitato a dedurre la sua contraffazione (cfr. Cass. sez. I, 02/12/2016, n. 24658 in materia di
brevetto), se – in altre parole ancora – le due condotte consistano nel medesimo addebito integrante la
violazione del segno (o del brevetto).
In buona sostanza, dall’illecito contraffattorio non discende automaticamente la concorrenza sleale, che – dunque – deve constare di un
quid pluris rispetto alla pura violazione del segno o del brevetto, cioè di una modalità ulteriore afferente il fatto illecito >> p. 6/7

Marchio di servizio al limite della distintività ma registrato: BLACK BIRTHING BILL OF RIGHTS

L’appello amministrativo del USPTO riforma e registra il marchio <BLACK BIRTHING BILL OF RIGHTS>  per servizi offerti da una “non-profit entity promoting improvements in Black maternal and infant health care”.

Rigettata la domanda in primo grado amministrativo per carenza di distintività, viene invece accolta in secondo grado:

<<We agree with Applicant that the specimens show BLACK BIRTHING BILL OF RIGHTS is used in rendering the identified services, and identifies Applicant as the source of those services. See In re ICE Futures U.S. Inc., 85 USPQ2d 1664, 1669 (TTAB 2008) (noting that use in the “rendition” of services is an element of the “sale” of services under Section 45 of the Trademark Act). In particular, Applicant’s social media posts featuring the BLACK BIRTHING BILL OF RIGHTS promote Black maternal and infant health care and are directed to the public at large, including both expectant mothers and care givers.
Moreover, the fact that at least six other “Bill of Rights” marks have registered for
a variety of services—including one for “public advocacy to promote awareness of credit, debit and payment card processing practices”—suggests that there is nothing inherently unregistrable about these kinds of marks.
>>

E poi:

Tenuto però conto che il cuore del servizio è la promozione di alcuni diritti a favore di donne e bambini di colore, sembrerebbe difficile -se fosse da noi- evitare la scure di nullità rappresentata dall’art. 13.1.b del c.p.i.

Sulla distintività del marchio UNI per matite e strumenti per scrittura

Il Tribunale UE con sentenza 13 luglio 2022, T-369/21, Unimax c. Mitsubishi Pencil, rigetta la domanda di nullità del (noto, forse <rinomato>) marchio denominativo UNI (scritto un pò schiacciato e in grassetto) per penne e strumenti di scrittura.

Il contestante allegava che il marchio , quale prefisso, ricordava le parole <university> e/o <unicolore> (monocromatico), il che rimandava a caratteristiche del prodotto o al suo uso.

Giustamente però il Tribunale conferma le decisioni amminsitrative e rigetta la domanda

Registrazione di marchio in malafede perchè sfruttante notorietà di precedente segno, però da tempo estinto? Un interessante caso (ceco)slovacco portato in UE

Trib. UE 06.07.2022, T.250/21, Zdut c. EUIPO, si esprime sul marchio denominativo NEHERA (per abbiglimento , tessuti etc.) registrato nonostante il nome fosse assai famoso nella ex Cecoslovacchia come marchio di impresa di inzio ‘900, poi estintosi.

Gli eredi dell’imprenditore omonimo non gradiscono e chiedono l’annullamento per deposito in malafede (art. 52.1.b reg. 207/2009)

A parte le considerazioni generali sull’istituto,. §§ 20-35, più interessante è -al solito- l’applicaizne al caso specifico, § 56 ss.

<< Orbene, un comportamento parassitario nei confronti della notorietà di un segno o di un nome, come quello menzionato dalla commissione di ricorso nella decisione impugnata al fine di fondare la constatazione della malafede del ricorrente, è possibile, in linea di principio, solo se tale segno o tale nome gode effettivamente e attualmente di una certa notorietà o di una certa celebrità (v., per analogia, sentenza del 3 settembre 2015, Iron & Smith, C‑125/14, EU:C:2015:539, punto 29).

58      In effetti, il giudice dell’Unione ha già constatato, nel caso di una persona che chiedeva la registrazione di un marchio dell’Unione europea, l’intenzione di trarre indebitamente vantaggio dalla notorietà residua di un marchio anteriore, anche quando quest’ultimo non era più utilizzato (sentenza dell’8 maggio 2014, Simca, T‑327/12, EU:T:2014:240), o dall’attuale celebrità del nome di una persona fisica (sentenza del 14 maggio 2019, NEYMAR, T‑795/17, non pubblicata, EU:T:2019:329), in ipotesi in cui tale notorietà residua o tale celebrità attuale era stata debitamente dimostrata. Per contro, esso ha constatato che non vi era usurpazione della notorietà di un termine rivendicato da un terzo e, quindi, non vi era malafede da parte del richiedente il marchio, quando tale termine non era né registrato, né utilizzato, né rinomato nell’Unione [v., in tal senso, sentenza del 29 novembre 2018, Khadi and Village Industries Commission/EUIPO – BNP Best Natural Products (Khadi Ayurveda), T‑683/17, non pubblicata, EU:T:2018:860, punti da 68 a 71].

59      In tali circostanze, in assenza di notorietà residua del vecchio marchio cecoslovacco e di celebrità attuale del nome Jan Nehera al momento del deposito della domanda di registrazione del marchio contestato, l’uso successivo da parte del ricorrente di quest’ultimo marchio non era, in linea di principio, idoneo a costituire un comportamento parassitario che rivelasse la malafede del ricorrente.

60      Tale conclusione non è rimessa in discussione dal fatto che il ricorrente fosse a conoscenza dell’esistenza e della notorietà passata del sig. Jan Nehera e del vecchio marchio cecoslovacco (v. precedenti punti 54 e 55). Infatti, la sola circostanza che il richiedente sappia o debba sapere che un terzo ha utilizzato, in passato, un marchio identico o simile al marchio richiesto non è sufficiente a provare l’esistenza della malafede del richiedente (v., in tal senso e per analogia, sentenze del 27 giugno 2013, Malaysia Dairy Industries, C‑320/12, EU:C:2013:435, punti 36 e 37 e giurisprudenza ivi citata, e del 29 novembre 2018, Khadi Ayurveda, T‑683/17, non pubblicata, EU:T:2018:860, punto 69)>>

Seguono poi altre cosnidrazioni sugli argiomenti <<diretti, in sostanza, a dimostrare l’intenzione di parassitismo e la malafede del ricorrente indipendentemente dall’esistenza di una notorietà residua del vecchio marchio cecoslovacco e del nome del sig. Jan Nehera.>>

Si bad che il pubblico aveva dimenticato il segno, § 66, e che è rimasto incerto processualmente se ci sia stato o no un tentativo di collegarsi indebitamente al vecchio marchio, § 68-69 (che però è dubbio assai inciderebbe sul marchio e non su concorenza sleale , pratiche scorrette , illecito aquiliano etc.);

Il giudizio rimane uguale: <<78    A tal riguardo è sufficiente constatare che, secondo la giurisprudenza citata al precedente punto 23, la nozione di malafede presuppone la presenza di una disposizione d’animo o di un’intenzione disonesta. Orbene, nel caso di specie, l’EUIPO e gli intervenienti non hanno dimostrato che il ricorrente fosse mosso da una disposizione d’animo o da un’intenzione disonesta al momento del deposito della domanda di registrazione del marchio contestato.

79      Da tutto quanto precede risulta che la commissione di ricorso ha ritenuto a torto che il ricorrente avesse intenzione di trarre indebitamente vantaggio dalla notorietà del sig. Jan Nehera e del vecchio marchio cecoslovacco concludendone che egli era in malafede al momento del deposito della domanda di registrazione del marchio contestato>>

La distinzione tra tributo ad un brand famoso e suo sfruttamento è sottile: anzi probabilmente non c’è e quindi sarà più o meno sempre sfruttamento.

Resta successivamente da vedere se questo costituisca  sempre e comunque <registrazione in malafede>. Tema complesso, dovendosi capire in relazione a quale scenario vada stimato l’intralcio ad inziative imprednitoriali, posto dalla mala fede. Ad es. nel caso de quo potevano gli eredi vantare una riserva di registrazione (come il nostro art. 8.3 cod. propr. ind., ad es.) solo per essere parenti/discendenti (di più di una generazione …) di un soggetto assai noto? Cioè potevano vantare un right of publicity ricevuto per via ereditaria (successione legittima o magari anche testamentaria, chissà), al pari di qualunque diritto su cose? Temi interessanti e difficili: potendosi ad es. dire che nel caso specifico la notorietà fosse stata acquisita primariamente come imprenditore e non potesse dunque essere invocato il cit. art. 8.3 cpi.
