La Cancellation Division EUIPO 17.10.2025 , Century Tal Holding (di Singapore) c. OpenAI Opco, ha deciso che il marchio in oggetto, registrato il 25.08.2021 (con priorità USA 04.08.2020), per classe 42 per servizi software, è nullo perchè descrittivo.
Il problema giuridico principale era il giudizio da rendere alla data del deposito prioritario (quello USA) : e ha deciso che all’epoca il termine era già descrittivo.
<<It is the opinion of the Cancellation Division, that Annex 8 (published in April 2020) together with the references to other articles published before the relevant date, confirms that already before the priority date of the contested EUTM, the acronym ‘GPT’ had been used denote a technology or AI system that involves ‘generative pre-trained transformers’ and had been immediately recognised, at least by the professional part of the relevant public, as an acronym identical to the full descriptive meaning ‘Generative Pretrained Transformer’. As correctly pointed out by the applicant, the addition ‘-3’ refers to the third (improved) generation/version of a GPT. As has already been confirmed, the relevant public is accustomed to such descriptive use when the numbers are used in connection with an acronym or an abbreviation (14/06/2023, R 259/2023-1 ‘HPD2’, §25). This meaning of the sign is obvious and can be understood directly from the contested mark without any elaborate interpretation or doubt. (…)
In light of the foregoing, it is concluded that the contested trade mark ‘GPT-3’ consists exclusively of an indication that may serve, in trade, to designate a characteristic of all the contested services in Class 42 and that this situation existed at the time of filing of the contested mark as well as at the priority date of the contested mark. Therefore, the mark has been registered contrary to the provision of Article 7(1)(c) EUTMR>>
