Sulla contraffazione di marchio figurativo registrato

Si vedano i tre marchi in lite (eccepite due anteriorità):

Registrante (Huawei):

Opponente (Chanel) per la tutela normale ex art. 8.1b reg. 2017/1001:

Sempre l’opponent Chanel per la tutela della rinomanza ex art. 8.5. reg. 2017/2001:

Dopo l’esito negativo in sede  amministrativa, Chanel tenta la via giudiziaria avanti il tribunale UE (T.).

Anche il T. però dà ragione al registrante e torto a Chanel con sentenza 21.04.2021, T-44/20, Chanel c. EUIPO (e Huawei).

(NB: i fatti di causa sono però giudicati ex reg. 2009 n° 207).

Il giudizio è duplice: la prima parte riguarda la rinomanza, la seconda il marchco ordinario.

Sulla prima parte il giudizio del T si appunta sulla <somiglianza>: la quale ricorre quando il pubblico è portato a ravvisare un link tra i marchi, § 23.

Preliminarmente (il punto è assai importante anche per la pratica), il T. dice che il giudizio va dato sui marchi così come registrati e non così come usati, §§ 25 e 32.  Nel caso specifico, essenzialmetne significa che il giudizio va dato tenendo fermi i rispettivi orientamenti verticale e orizzontale indicati in domanda.

Ci sono però opinioni diverse sia in giurisprudenza, pure europea, sia in dottrina italiana (Vanzetti – Di Cataldo,  Manuale di diritto industriale, Giuffrè, 2018, 8 ed., 240-1).

Per vero questi aa. ne parlano sul giudizio di confondibilità di marchio ordinario, mentre il T. circa la somiglianza ad un marchio rinomato: ma non c’è motivo di adottare criteri diversi (la confondibilità si basa, quanto ai segni, proprio sulla loro somiglianza. art. 8.1.b reg. 2007 del 2009). In breve, il concetto di <somiglianza> dei segni a paragone va inteso allo stesso modo nei due casi.

Ci son bensì delle somiglianze, § 34.

Ma anche differenze: <<35.    The visual differences between the marks at issue result, first, from the more rounded shape of the curves, resembling the image of two letters ‘c’ in the allegedly reputed mark, as compared with the image of the letter ‘h’ in the mark applied for, second, from the different stylisation of those curves and their arrangement, horizontally in the allegedly reputed mark and vertically in the mark applied for, third, the orientation of the central ellipse, resulting from the intersection of those curves, vertical in the allegedly reputed mark and horizontal in the mark applied for and, fourth, the greater thickness of the line of those curves in the allegedly reputed mark as compared with the line of the curves in the mark applied for, as well as the line forming the circle of the mark applied for as compared with that of the allegedly reputed mark.  36.  Furthermore, although the intersection of the interlaced curves of the mark applied for is visible, in that the line is interrupted in the places where those curves cross, the same is not true of the allegedly reputed mark. It can also be noted that the distance between the line forming the circle and the ends of the curves in each of the marks at issue, namely the points where those curves begin and end, differs>>.

Per cui visivamente son diversi, § 37.

Il giudizo fonetico non si può dare, § 38.

Concettualmetne , infine, sono pure diversi, § 39-40: quello di Huawei fa infatti pensare a due U contrapposte verticalmente oppure ad una H.

Secondo giudizio , sulla tutela ordinaria, § 43 ss: le cose non cambiano e anche qui il ricorso Chanel va rigettato, sostanzialmente per le stesse ragioni.
